The north Dakota supreme court has taken under advisement a new appeal from a manvel man convicted of murder. rodney chisolm was found guilty in 2010 of killing his brother and sentenced to 30-years. The state’s high court upheld the conviction in January 2012. in august of last year chisolm filed for post conviction relief citing among other things ineffective legal counsel. The district court rejected the argument in december as frivolous and without merit. In the latest appeal the defense argues their client is not being allowed an opportunity to be heard and his former attorney was distracted by drug addiction. the justices listened to oral arguments this week and will rule at a later date.
